DECISION of 17 December 1981 on the admissibility of the application

DECISION du 17 décembre 1981 sur la recevabilité de la requête

Articles 3, 8, 13 and 14 of the Convention : lmpossibility of having crimina l

proceedings instituted against the perpetrator of a serual assault committed

against a mentally deficient person of the female sex over the age of 16,

because the law requires the victim to lodge a complaint personally but his

menta l incapacity does not permit this (Complaint declared admissible) .

THE FACTS

The applicant is a Netherlands citizen, born in 1929 and residing in N .

He has submitted the application with the Commission in his own name and

on behalf of his 19-year-old daughter . He is repre sented by Miss van Westerlaak,

a lawyer practising in Elst .

The applicant states that in 1977 his daughter, then 16 years old and

mentally handicapped . lived in a Children's Home for mentally defective

child ren in M . where she was receiving special care and that in the night of

14/IS December 1977 the son-in-law of the Directress of the Home, Mr B .

had intercourse with her . It is further alleged that during the same night, he

also commi tt ed sexual acts with two other girls .

On 16 December 1977 the applicant registered a complaint with the

local police, consisting of a factual account of the events . The complaint

contained the statement that the applicant had lodged it in his parental

capacity because his daughter, although sixteen years of age, was mentally still

a child and thus incapable of acting for herself . The police report stated that

Mr B . did not use force or threaten the use of force and that the offence was

in violation of Section 143 and 148 of the Penal Code .

The applicant was told by the police officer in charge that he himself

could sign the complaint as his daughter was thought to be incapable of doing

so in view of her mental condition .

The police officer subsequently informed the Public Prosecutor that in

view of the father's statement and of his own observation of the mental

condition of the girl he was of the opinion that the girl could not lodge the

complaint herself . The director and a teacher of the school who were interviewed by the police later did not consider her to be capable of expressing her

will as to the lodging of a complaint .

On receipt of the police report the Arnhem Public Prosecutor instructed

a probation and after-care agency to draw up a personal report on B . and on

29 May 1978, after questioning him in person, conditionally dropped the

charge for two years .

On 27 September 1978 the applicant had an interview with the Public

Prosecutor concerned, who explained to him that he had been prevented from

prosecuting B . under Section 248 ter of the Penal Code* as he was only

allowed to do so after the victim herself had lodged a complaint within the

time-limit prescribed, which had not been the case .

Thereupon the applicant lodged a complaint against the Public Prosecutor's decision with the Court of Appeal in Arnhem under Section 12 of the

Code of Criminal Procedure . He complained that upon the indication of the

police officer he had signed the complaint ; that he had done so was now held

against him . He further stated that it was inadmissible that under Section 248 ter

the prosecution of such offenders was impossible if the victim under age was

incapable of lodging a complaint and the parent as legal representative was

not allowed to do so .

On 12 July 1979 the Court of Appeal in Arnhem rejected the appeal on

the ground that it was unlikely that a charge on a count of rape (Section 242

of the Penal Code) could be proven and that the prosecution of B . under

Section 248 ter was not possible since the victim herself had not lodged a

complaint as required by Section 64(1) of the Code' . The Court further

stated that the fact that the girl's father had lodged a complaint as he

considered her incapable of measuring the impact of lodging such a complaint

could not be of any relevance in this respect . The Court admitted that the

police authorities had also considered that the applicant's daughter was incapable of lawfully lodging a complaint herself and had told the applicant so

who therefore could assume that he was entitled to lodge a complaint herself .

In the Court's opinion it was a flaw in the law that there was no person

entitled to complain in cases where the victim was over sixteen years and not

placed under guardianship, but was proven to be incapable of determining her

wifl as to the question of lodging a complaint .

According to Section 445 of the Code of Criminal Procedure there is no

appeal on points of law to the Supreme Court against such a decision .

Complaint s

The applicant submits that the Netherlands legislation is insufficient as

regards the protection of mental defectives over 16 years of age against sexual

abuse as laid down in Section 248ter of the Penal Code .

He further submits that he does not claim the right to have criminal

proceedings instituted against a third person but that the impossibility of

instituting criminal proceedings in the present case is an indication of the

insufficiency of the existing protection of the female mental defective against

sexual abuse and its discriminatory character .

The applicant states that the right to respect for the integrity of one's

body is based on Articles 3 and 8 of the Convention .

As to Article 3

In his opinion sexual abuse falls clearly within the scope of the interpretation of the terms "inhuman and degrading treatment" as given by the

Commission in the Greek case .

As to Artic(e 8

The applicant submits that the right to respect for private life certainly

includes the right to integrity of one's body, the effective protection of which

may require positive action by the State (cf . Airey case, para . 32) . He further

refers to paragraph 54 of the Commission's Report in the Brilggemann and

Scheuten case (v . the Federal Republic of Germany) analogously claiming that

penal legislation for combating sexual abuse affects the private sphere . In his

opinion Article 8 also includes the right of the parents to stand for their

children in law .

As to Article 1 4

Positive action by the State constitutes, in the applicant's view, the

protection of the physical integrity by penal sanctions to sexual abuse . The

victims of such abuse should have the possibility of lodging a complaint with

the Public Prosecutor . Protection is not provided in an equal manner when in

some cases sexual abuse may remain with impunity because of a flaw in the

law . The distinction made by the Netherlands legislation in so far as the age of

the victim is concemed may well be justified, but if mentally handicapped

persons of a certain age, as was the applicant's daughter, cannot enjoy any

protection whatsoever the distinction is discriminatory . Even further protective

measures may be called for in these cases (cf . para . 60 of the Winterwerp

judgment) .

As to Article 1 3

The applicant submits that although the Court of Appeal has dealt with

the appeal by the applicant and his wife on behalf of their daughter, it

decided that, in the circumstances of the case, they were not entitled to lodge

a complaint despite the incapability of their daugher of doing so herself . The

applicant therefore concludes that this remedy was not an effective one .

PROCEEDINGS BEFORE THE COMMISSIO N

On 11 March 1981 the Commission decided that, in accordance with

Rule 42(2)(b) of the Rules of Procedure, notice should be given to the

respondent Government of the application and that they should be invited to

submit their observations in writing on the admissibility of the application .

The Government's observations were received on 26 May 1981 and the

applicant replied on 27 November 1981 .

SUBM1HSSIONS OF THE PARTIE S

Submissions of the Government

As to the fact s

The Government pointed out that the Public Prosecutor conditionally

dropped the charge for two years because of lack of evidence to support a

charge of rape and that the fact that the complaint was not fully consistent

with the requ'vements for complaints concerning offences under Section 248 of

the Penal Code . In their view, in addition, the Public Prosecutor might have

been influenced in his decision by the consideration that the campaign conducted against B . by one or more women's groups in N . as a result of the

offence had seriously affected his personal life and the operation of his

business . The decision conditionally to drop the charge for two years had been

prompted by the desire to so something more in view of the circumstances

than simply to drop the charge, and in that way to exert some influence upon

B .'s future conduct .

As to Netherlands law

The Government explained the Netherlands law, in so far as it might be

of re levance in the present case, in the following way :

With due observance of the principle that the State should refrain from

interference in sexual matters in the private sphere, Netherlands criminal law

in respect of unacceptable sexual acts is based on two complementary premises .

Firstly, the relevant provisions of the Penal Code are designed to protect

the freedom of the individual to accept or reject sexual relations . Secondly,

persons who must be assumed to be wholly or in some degree incapable of

volition are to be protected from the sexual advances of others . It follows from

this that under Netherlands criminal law it is an offence to compel sexual

submission by the use or threat of force (Section 242 : rape ; Section 246 :

sexual assault) . It should be noted that the protection afforded by Section 242

extends only to women and that forced sexual relations in marriage do not fall

under the definition of rape . The other provisions in the Penal Code relate to

the protection of persons whose age, position or dependence or physical

incapacity render it difficult or impossible for them to make their will prevail .

Sexual intercourse with girls between the ages of 12 and 16 years and with

girls under the age of 12 years is an offence under Sections 245 and 244

respectively . In addition, indecent acts with young persons of both sexes under

the age of 16 are punishable under Section 247 . Sexual intercourse with a

woman whom the offender knows to be unconscious or helpless, and indecent

acts committed against such a penon, are punishable under Sections 243 and

247 respectively . It should be noted in this connection that in the case law of

the Supreme Court "helplessness" has invariably been defined as physical

helplessness. Thus cases in which the victim's mental condition renders he r

wholly or partly incapable of volition do not fall within the scope of these

provisions .

Under Section 249 the sexual abuse of a person whose relationship with

the offender is one of dependence is a punishable offence . It relates to

relations with a minor who has been entrusted to the care, authority or

vigilance of the offender as his child, pupil or subordinate, relations between

public servants and their subordinates and relations between the staff of

institutions and the persons cared for in such institutions .

Section 248 ter, which has been cited in the present case, is somewhat

different . It concerns the inducement of minors of blameless conduct who are

1 6 years or older to commit or tolerate sexual acts, "inducement" being

understood to mean the use of the means referred to in this Section to overcome the mental resistance of the victim . It should be noted that this section,

which was incorporated in Netherlands criminal law in 1911 and was further

elaborated in 1936, has proved difficult to apply in practice . Moreover, very

few cases have been brought on these grounds, only five persons having been

convicted of an offence under this Section between 1971 and 1975 .

As to the applicability of Netherlands law to the fact s

Sections 242 and 246 are not applicable to the facts of the present case

because it does not involve the use or threat of force, an element which is

crucial to their applicability . Sections 245 and 247, in so far as they provide

protection for young persons, are likewise inapplicable because of the age

(16 years) of the victim .

Section 243 (and Section 247, in so far as it corresponds to Section 243)

provide no grounds for prosecution because according to the law the mental

condition of the girl is not consistent with the terms "unconscious" or "helpless" . The same applies with respect to Section 249 in that her relationship

with the offender could not be construed as one of dependence .

The only section of the Penal Code under which the Public Prosecutor

might have instituted proceedings with any chance of obtaining a conviction is

Section 248 ter, though here too-even assuming that the formal requirements

concerning the lodging of a complaint were met-it is highly debatable

whether a convictin could actually have followed . First of all, in view of the

mental condition of the victim, there is a considerable measure of doubt as to

whether the point of "inducement" could have been proven . Furthermore, as

regards the means of inducement used, it is doubtful whether this could have

been shown to be "authority stemming from factual relations" . The other

means of inducement referred to in this Section would not correspond to the

facts at all .

As to the complaint to the local police

The Government observed that guardianship as refer re d to in Section 64 (1)

of the Penal Code ( cited in the decision of the Cou rt of Appeal of 12 July 1979)

is possible solely in respect of pe rsons who have reached the age of majority

(Section 378, Book I, Civil Code) . Such guardianship therefore could not

constitute a means for lodging a complaint .

To be legally valid, a complaint must be lodged by a person who can be

considered responsible for the action this involves . The pri nciple on which this

is based is that the person concerned must be deemed capable of judging the

pros and cons of prosecu ti on . If the mental condition of the victim is such that

he or she must be deemed incapable of making such a judgment, the complaint lacks the requisite element of responsibility and should th erefore, in the

opinion of the Netherlands Government, be accorded no legal recogni ti on .

In Ne therlands case law it is a formal requirement which is strictly

obse rv ed that, in the case of an offence which is only indictable on complaint,

such a complaint must be re gistered by a pers on who is competent to do so .

Reference is made in this context to the grounds on which the Court of Appeal

in Amhem based its decision in this case . If in this case the Public Prosecutor

had instituted criminal proceedings on the basis of the complaint signed by

the applicant as the father of the victim, it must almost ce rtainly be assumed

that the court would have declared his action inadmissible .

Further observations

As to the question whether the Public Prosecutor could have instituted

criminal proceedings against B . if the applicant's daughter herself had signed

the complaint the Government pointed out that, if she had done so, this

action could hardty have been deemed to proceed from her own volition,

considering her mental capacities . In the Goverment's opinion the complaint

could then have failed to comply with an essential condition for legal recognition and, as a consequence, the Public Prosecutor could not have instituted

criminal proceedings .

The Government had no knowledge of any case in which criminal

proceedings had been instituted on the basis of a complaint lodged by an

obvious mental defective . Prosecution in such cases as the present one, where

the victim is a low-grade mental defective, was not possible .

As a final observation the Govemment submitted that, having regard to

the fact that there was no further appeal against the decision of the Amhem

Court of Appeal, and in view of the above observations, they referred the

question of the admissibility of the application to the decision of the Commission .

As to the question whether there had been interferences with the applicant's daughter's rights under Articles 3, 8 and 14 the Government observed

that at this stage they preferred not to give a statement of its views on the

merits of the case, pending the Commission's decision on the admissibility .

Such a statement of views would involve detailed argumentation, going beyond

the scope of the present observations on the admissibility .

Submiss{ons of the appllcent

The applicant stated that he had nothing to add to his initial submissions .

THE LA W

The applicant has complained that his rights under the Convention and

those of his daughter have been violated by reason of the fact that Netherlands

law failed to afford protection against the kind of sexual abuse to which his

daughter, being a mentally defective person, had been subjected . He has

invoked Articles 3 . 8, 13 and 14 of the Convention .

The respondent Government have made submissions as to the facts of

the case, as to Netherlands law and its applicability to the facts . They have

further referred the question of the admissibility of the application to the

decision of the Commission reserving the right to make substantial submissions on the merits of the case .

The Commission has car ri ed out a prelimina ry examination of the information and arguments submitted by the pa rt ies . It finds that the application raises impo rt ant questions under the Convention and is of such complexity that the determination of the issues concemed should depend on an

examination of their merits . It follows that the application cannot be regarded

as manifestly ill-founded within the meaning of Article 27 ( 2) of the Convention, and no other ground for decla ri ng it inadmissible has been established or

has even been submitted .

The Commission, therefore, without prejudging the me ri ts

DECLARES THIS APPLICATION ADMISSIBLE .

EN FAIT

Le requérant est un ressortissant néerlandais né en 1929 et habitant N .

11 a introduit la présente requête devant la Commission en son propre nom et

au nom de sa fille âgée de 19 ans . Il est représenté par W van Westerlaak,

avocate à Elst .

Le requérant déclare qu'en 1977 sa fille, alors âgée de 16 ans et handicapée mentale, vivait à M . dans un foyer pour enfants déficients mentaux où

elle recevait des soins pa rt iculiers et que, dans la nuit du 14 au 15 décembre 1977,

le gendre de la direct ri ce du foyer, M . B ., eut avec la jeune fi lle des rapports

sexuels . Il est allégué en outre que, la méme nuit, M .B . commit des actes de

caractère sexuel avec deux autres jeunes filles .

Le 16 décembre 1977, le requérant a déposé auprès de la police locale

une plainte donnant un compte rendu des événements . Dans cette plainte, le

requérant déclarait déposer celle-ci en sa qualité de parent, sa fille, bien

qu'âgée de 16 ans, étant encore mentalement une enfant et donc incapable

d'agir elle-même . Le rapport de police indique que M . B . n'a pas usé de

violence ni menacé d'en user et que l'infrac ti on était punie par les a rt icles 143

et 148 du Code pénal .

Ix commisai re de police indiqua au requérant qu'il pouvait signer luimême la plainte puisqu'il estimait sa fille incapable de le faire en raison de

son état mental . Il informa ulté rieurement le parquet que . vu la déclara ti on

du père et ses propres constatations quant à l'état mental de la jeune fille, il

estimait que l'intéressée ne pouvait pas 'po rt er plainte elle-même . Selon le

directeur et un professeur de l'école, interrogés ulté rieurement par la police, la

jeune fille ne pouvait pas exp ri mer sa volonté quant au dépôt de la plainte .

Au reç u du rapport de police, le parquet d'Arnhem chargea un organisme de probation et d'assistance post-péniten ti aire d'établir un rapport sur

la personne de B . Le 29 mai 1978, après avoir interrogé personnellement B ., le

parquet suspendit les poursuites pour deux ans sous condition .

Le 27 septembre 1978, le requérant eut un entre ti en avec le membre du

parquet chargé de l'affaire, qui lui expliqua qu'il n'avait pas pu engager des

poursuites contre B . aux termes de l'a rticle 248 ter du Code pénal', faute

d'une plainte de la victime elle-même dans le délai prescrit .

Le requérant se pourvut alors contre la décision du parquet auprès de la

cour d'appel d'Arnhem, conformément à l'article 12 du Code de procédure

pénale . II se plaignait que, sur indication du commissaire de police, il avait

signé la plainte et que cela lui était maintenant opposé . Il estimait en outre

inadmissible qu'en vertu de l'article 248 ter, il fût impossible de poursuivre ce

genre de délinquant si la victime mineure est incapable de porter plainte ellemême et que le parent, en sa qualité de représentant légal, n'est pas autorisé à

le faire .

Le 12 juillet 1979, la cour d'appel d'Arnhem rejeta le recours au motif

qu'il était peu probable qu'une accusation de viol (article 242 du Code pénal)

puisse être prouvée et qu'il n'était pas possible de poursuivre B . en vertu de

l'article 248 ter, puisque la victime elle-même n'avait pas porté plainte comme

prévu à l'article 64, paragraphe 1, du Code• . La cour déclara en outre qu'il

était sans pertinence que le père de la jeune fille ait porté plainte parce qu'il

estimait sa fille incapable d'apprécier l'effet de ce genre de plainte . La cour

était consciente du fait que la police avait estimé la fille du requérant incapable de porter légalement plainte elle-même et en avait fait part au requérant,

qui avait donc pu penser qu'il était habilité à le faire lui-même .

De l'avis de la cour, il y a là une lacune de la loi, puisque personne n'est

autorisé à porter plainte lorsque la victime a plus de 16 ans, n'est pas placée

sous tutelle, mais se révèle incapable de déterminer sa volonté quant au dépôt

d'une plainte .

Selon l'article 445 du Code de procédure pénale, ce genre de décision

n'est pas susceptible de pourvoi en cassation devant la Cour suprême .

Griefs

Le requérant soutient que la législation nééerlandaise ne protège pas

suffisamment les déficients mentaux de plus de 16 ans contre les délits sexuels

punis par l'article 248 ter du Code pénal .

Il soutient en outre qu'il ne revendique pas le droit d'engager une

procédure pénale contre un tiers . Cependant, l'impossibilité de déclencher des

poursuites pénales en l'espèce montre, d'une part, l'insuffisance de la protection légale des déficients mentaux de sexe féminin contre les délits sexuels et,

d'autre part, son caractère discriminatoire .

Le requérant déclare que le droit au respect de l'intégrité corporelle

découle des articles 3 et 8 de la Convention .

Sur ('article 3

A son avis, les atteintes à l'intégrité sexuelle relèvent clairement de

l'interprétation des termes . traitement inhumain et dégradant . donnés par la

Commission dans l'Affaire .grecque .

Sur l'article 8

Le requérant soutient que le droit au respect de la vie privée comporte

certainement le droit à l'intégrité corporelle, dont la protection effective peut

exiger des mesures positives de la part de l'Etat (cf . Affaire Airey, par . 32) . 11

se réfère en outre au paragraphe 54 du rapport de la Commission dans

l'affaire Brüggemann et Scheuten (c/République Fédérale d'Allemagne) . en

prétendant de même que la législation pénale de lutte contre les atteintes à

l'intégrité sexuelle touche au domaine de la vie privée . A son avis, l'article 8

inclut également le droit pour les parents d'ester en justice pour leurs enfants .

Sur l'article 1 4

Selon le requérant ces mesures positives de la part de l'Etat exigent

protection de l'intégrité physique de l'individu en sanctionnant pénalement les

atteintes à l'intégrité sexuelle . Les victimes de pareilles a tt eintes doivent pouvoir porter plainte auprès du parquet . Or, la protection foumie n'est pas la

même pour tous si cert ains délits sexuels restent impunis par suite d'une

lacune de la loi . La distinction faite par la législation néerlandaise quant à

l'âge de la victime peut se justifier mais si les handicapés mentaux d'un

cert ain âge, comme c'est le cas de la fille du requérant, ne peuvent bénéficier

d'aucune protection, alors la distinction est disc ri minatoire . Ce genre de cas

peut exiger des mesures encore plus protect ri ces ( cf. par . 60 de l'arrét Winterwerp) .

Sur !'article 13

Le requérant soutient que si la cour d'appel a bien examiné le recours

formé par le requérant et son épouse au nom de leur fille, elle a néanmoins

décidé que, dans les circonstances de l'espèce, les parents n'étaient pas habilités à porter plainte malgré l'incapacité de leur fille à le faire elle-même . Le

requérant en conclut que ce recours n'était pas effectif .

PROCÉDURE DEVANT LA COMI1fISSIO N

Le I l mars 1981, la Commission a décidé, conformément à l'article 42,

paragraphe 2b) de son Règlement intérieur, de donner connaissance de la

requête au Gouvernement défendeur et d'inviter ce dernier à lui présenter par

écrit ses observations sur la recevabilité de la requête .

Les observations du Gouvernement sont parvenues à la Commission le

26 mai 1981 et le requérant y a répondu le 27 novembre 1981 .

ARGUMENTATION DES PARTIE S

Argumentation du Gouvernement

Sur les faits

Le Gouvemement souligne que le parquet a suspendu les poursuites sous

condition pour deux ans en raison a) du manque de preuves pour étayer une

accusation de viol et b) du fait que la plainte ne remplissait pas totalement les

conditions prévues pour ces délits par l'article 248 du Code pénal . En outre,

selon lui, le parquet a pu être influencé dans sa décision par l'idée que la

campagne menée contre B . à la suite de ce délit par un ou plusieurs groupements féminins de Nimègue avait gravement affecté la vie personnelle de

l'intéressé et la marche de ses affaires . La décision de suspendre les poursuites

sous condition pendant deux ans s'inspirait du désir de faire quelque chose de

plus, vu les circonstances, qu'un simple classement de l'affaire et d'exercer

ainsi quelque influence sur le comportement futur de B .

Surla (égislation néerlandaise

Le Gouvernement a expliqué comme suit la législation néerlandaise,

dans la mesure où elle intéresse la présente affaire :

Tout en respectant strictement le principe que l'Etat doit s'abstenir

d'intervenir dans les questions sexuelles relevant de la vie privée, le droit pénal

néerlandais se fonde, pour ce qui est des actes sexuels inadmissibles, sur deux

prémisses complémentaires .

Premièrement, les dispositions pertinentes du Code pénal visent à protéger la liberté de l'individu d'accepter ou de repousser des propositions de

relations sexuelles . Deuxièmement, les personnes supposées être, en tout ou en

partie, incapables de volition doivent être protégées contre les avances sexuelles

d'autrui . Il s'ensuit qu'en droit pénal néerlandais, constitue un délit le fait

d'obliger quelqu'un par la violence ou la menace de violence à se soumettre

sexuellement (l'article 242 punit le viol et l'article 246 les violences sexuelles) .

Il est à remarquer que la protection offerte par l'article 242 ne s'étend qu'aux

femmes et que les relations sexuelles obtenues de force dans le mariage ne

relèvent pas de la définition du viol . Les autres dispositions du Code pénal

concernent la protection de personnes pour qui il est difficile ou impossible de

faire prévaloir leur volonté en raison de leur âge, de leur situation, dépendance ou incapacité physique . Les relations sexuelles avec des jeunes filles de

12 à 16 ans et des fillettes de moins de 12 ans sont un délit puni par les

articles 245 et 244 respectivement . De plus, l'article 247 punit les attentats à

la pudeur sur de jeunes garçons ou filles de moins de 16 ans . Les articles 243

et 247 respectivement punissent les rapports sexuels avec une femme que le

délinquant sait être inconsciente ou incapable de résistance et les attentats à la

pudeur contre une telle personne . Il faut relever à cet égard que, dans l a

sexuelle d'une personne qui se trouve en relation de dépendance vis-à-vis de

l'auteur : par exemple, relations avec un mineur confié aux soins, à l'autorité

ou la vigilance du délinquant en qualité d'enfant, de pupille ou de subordonné,

rapports entre les fonctionnaires et leurs subordonnés et relations entre le

personnel de certains établissements et les personnes qui leur sont confiées .

L'article 248 ter, cité en l'espèce, est quelque peu différent puisqu'il

concerne l'incitation de mineurs innocents et âgés d'au moins 16 ans à commettre ou tolérer des actes sexuels, .l'incitation+ étant entendue au sens de

n:cours aux moyens évoqués dans cet article pour vaincre la résistance psychique de la victime . Il faut noter que cet article, incorporé dans le droit pénal

néerlandais en 1911 et modifié en 1936, s'est révélé difficile à appliquer . En

outre, très rares ont été les poursuites intentées sur cette base puisqu'entre

1971 et 1975, cinq personnes seulement ont été condamnées de ce chef .

Sur l'applicabilité de la législation néerlandaise aus faits de la caus e

Les articles 242 et 246 ne sont pas applicables aux faits de la cause

puisqu'il n'y a pas eu, en l'espèce, usage ou menace de violence, élément

indispensable pour appliquer ces textes . Les articles 245 et 247, pour autant

qu'ils assurent la protection des jeunes, ne s'appliquent pas non plus en raison

de l'âge de la victime (16 ans) .

L'article 243 (et aussi l'article 247 dans la mesure où il est en corrélation

avec l'article 243) ne permet pas de poursuites non plus puisque, selon la loi,

l'état mental de la jeune fille n'est pas compatible avec les termes . inconscient »

ou . incapable de résistance . . Il en est de même de l'article 249, puisque les

rapports de la jeune fille avec le délinquant ne sauraient être interprétés

comme des relations de dépendance .

Le seul article du Code pénal en vertu duquel le parquet aurait pu

engager des poursuites avec quelque chance d'obtenir une condamnation est

l'article 248 ter ; cependant, à supposer même que les conditions formelles de

dépôt de la plainte aient été remplies, il est fort douteux qu'une condamnation

aurait pu réellement s'ensuivre . Tout d'abord, vu l'état mental de la victime, il

est très peu problable que l'on ait pu apporter la preuve de .1'incitation . . De

plus, en ce qui concerne les moyens d'incitation utilisés, il est douteux que

l'on aurait pu montrer qu'il s'agissait . d'autorité découlant de relations de

fait . . Les autres moyens d'incitation énumérés dans l'article ne correspondent

absolument pas aux faits de la cause .

Sur la plain(e à la police locale

Le Gouvernement fait re marquer que la tutelle é voquée à l'a rticle 64,

paragraphe 1 du Code pénal (cité dans l'arrêt de la cour d'appel du 12 juillet

n'est possible qu'à l'égard de personnes majeures (article 378, Livre 1, Code

civil) . Cette tutelle ne pouvait donc être utilisée pour po rter plainte .

Pour être valable aux yeux de la loi, la plainte doit être déposée par une

personne censée assumer la responsabilité de son geste, le p ri ncipe sous-jacent

étant que l'intéressé doit être capable d'apprécier le pour et le contre des

pou rsuites . Si l'état mental de la victime est tel qu'il ou elle doit êt re considéré

comme incapable de po rter cette appréciation, la condition indispensable de

responsabilité fait défaut à la plainte qui, selon le Gouvernement néerlandais,

ne peut se voir reconnaitre une valeur juridique .

Pour la jurisprudence néerlandaise, c'est une exigence de forme à obse rv er ri goureusement que, pour un délit dont l'auteur ne peut êt re poursuivi

que sur plainte, celle-ci doit être déposée par une personne ayant qualité pour

le faire . Il est fait réfé rence à cet égard aux motifs sur lesquels la cour d'appel

d'Amhem a fondé son arrét en l'espèce . Si le parquet avait engagé en l'espèce

des poursuites pénales sur la base de la plainte signée par le requérant en sa

qualité de pè re de la victime, il est quasi ce rt ain que la cour aurait déclaré

l'action pénale irrecevable .

Observations complémentaires

Quant au point de savoir si le parquet aurait pu engager des poursuites

pénales contre B . si la fille du requérant avait elle-même signé la plainte, le

Gouvemement souligne que cet acte n'aurait alors guère pu être considéré

comme procédant de sa volonté propre, vu ses capacités mentales . De l'avis du

Gouvernement, la plainte aurait alors manqué de la condition essentielle pour

être reconnue juridiquement et le parquet n'aurait donc pas pu engager de

poutsuites .

Le Gouvernement n'a pas connaissance de cas où des poursuites pénales

ont été intentées sur la base d'une plainte déposée par un déficient mental . Il

n'est pas possible de poursuivre lorsque, comme en l'espèce, la victime est un

déficient mental grave .

En guise d'observation finale, le Gouvernement déclare qu'aucun autre

recours n'étant ouvert contre l'arrêt de la cour d'appel d'Arnhem et compte

tenu des observations précédentes, il laisse à la Commission le soin d'apprécier

la question de la recevabilité de la requête .

Sur la question de savoir s'il y a eu ingérence dans l'exercice des droits

garantis à la fille du requérant par les articles 3, 8 et 14, le Gouvemement

déclare qu'à ce stade il préfère différer l'exposé de son point de vue sur le

fond de l'affaire, en attendant la décision de la Commission sur la recevabilité .

En effet, cet exposé appelle une argumentation détaillée qui dépasse la portée

des présentes obse rv ations sur la recevabilité .

Argumentation du requérant

Le requérant a déclaré qu'il n'avait rien à ajouter à son exposé initial .

EN DROI T

Le requérant se plaint d'une violation des droits que la Convention lui

garantit ainsi qu'à sa fille en raison du fait que la législation néerlandaise ne

prévoit pas de protection contre les atteintes à l'intégrité sexuelle du genre de

celles subies par sa fille, déficiente mentale . Il invoque les articles 3, 8, 13 et

14 de la Convention .

Le Gouvernement défendeur a présenté des observations sur les faits de

la cause, sur la législation néerlandaise et son applicabilité au cas d'espèce . Il

a en outre laissé à la Commission le soin de décider de la recevabilité de la

requête en se réservant de présenter de plus amples observations sur le fond de

l'affaire .

La Commission a procédé à un examen préliminaire des renseignements

et arguments fournis par les parties . Elle estime que la requête pose au regard

de la Convention d'importantes questions d'une telle complexité qu'il ne peut

être statué à leur sujet qu'après un examen au fond . Il s'ensuit que la requête

ne saurait étre considérée comme manifestement mal fondée au sens de

l'article 27, paragraphe 2, de la Convention, aucun autre motif d'irrecevabilité

n'ayant été établi ni même allégué .

La Commission, tout moyen de fond étant rése rvé,

DECLARE LA REQUÊTE RECEVABLE .
