EN FAIT

Les falts de la cause peuvent se résumer comme suit :

Le requérant est un ressortissant suisse né en 1932 . 11 est journaliste et

réside à Forch (Zurich) . Il est représenté devant la Commission par Maitre

Manfred Kuhn, avocat à Zurich .

En 1972, le requérant fit l'objet d'une accusation privée formée par

citation directe par une société commerciale et son administrateur pour atteinte

à l'honneur par voie de presse . Dans un article paru en janvier 1972, le

requérant les avait accusés d'escroquerie et réclamé une perquisit' i domiciliaire et la mise en détention provisoire de l'administrateur de la aociété . Il

leur avait reproché d'avoir provoqué des inscriptions non voulues dans u n

annuaire téléphonique privé, en adressant aux destinataires des factures identiques aux notes de téléphone des P .T .T .

Le procès sur cette accusation pénale privée'(Privatstrafklageverfahren )

dans lequel le Ministére public ne jtiue aucun r8le, fut suspendu pendant

plusieurs années à la demande des plaignants, dans l'a tt ente de l'issue d'un

autre procès concernant des faitssimilaires : ~ .

Le 12 mai 19'6 . la chambre de la Cour d'assises du canton de Zuric h

décida de ne pas admettre la plainte,forinée par citatioti directe en raisôn de

la prescription absolue su rv enue entre-temps, les faits ' s'étant déroulés plus de

quatre ansplus tôt . La décision ( Beschluss)'met à la charge du requérant les

deux tiers des frais de l'instruction et du procès, _ soit environ 370 francs

suisses, et le condamne à payer à chacun des plaignants' une indemnité de

procès ( Prozessentschadigung) de 600 Francs suisses, destinée à couvrir leurs

frais d'avocats . .,

Pour liquider les dépens ; les juges se ftindaietitsur l'article 293 du code

de proèédûre pénale du cadton, qui permet de ne pas lés me tt re à la charge de

la partie succombante lorsque des « circonstances spécialès - le justifient . Se

posanr l a question de savoir`quel aurait é téle jugement si la prescription

n'était p -u'intervenué (- wie das Urteil gelautet hatte . wennkeine Verjàhrung

vorlàgc • ; . les juges estimèrentque si le rèquérant avait pris l'indispensable

précaution de s'informer au préalable auprès des personnes mises en cause, .il

aurait pu tout au plus critiquer la méthode commerciale employée ; il n'aurait

pu parler d'escroquerie, faute d'intention dolosive . Les juges se référaient à cet

égard aux constatations d'un autre tribunal dans un litigeopposant, pour des

faits . analogues, les mêmes plaignants et un autre journaliste . Puisque :le

requérant avait néanmoins lancé l'accusation d'escroquerie, il aurait selon

toute vraisemblance été condamné dans la présente procédure pour atteinte!à

l'honneur, si la prescription n'était pas intervenue (« indem er das aber trotzdeni getan hat . wàre er aller Voraussicht nach im vorliegenden Ehrverletzungsprozess bei Nichteintritt der Verjïhrurig verurteilt worden .) . Cette conclusion

s'intposait d'autant plus, selon les juges, que des poursuites pour escroquerie

ouve rtes à l'instigation de M . Minelli, dans un autre canton contre la , société

contmerciale et son directeur, pa rt ies plaignantes dans la présente affaire,

avaient d0faire l'objet d'un non-lieu(Einstellung) : les élémerits constitutifs de

l'escroquerie n'ayant pu être établis

. En liquidant les dépens, le tribunal tint égalerhent compte du contpo rt enient des plaignants avant la procédure . Il conclut qu'ils avaient, par leurs

pratiques commerciales incorrectes, provoqué la réaction - excessive -ldu

requérant .

Le requérant forma aussitôt un recours en nullité devant le tribunal .de

cassation du canton, invoquant notamment l'article 6, paragràphe 2, de l a

Convention européenne des Droits de l'Homme . Ce recours fut rejeté par

décision du 30 Septembre 1976 .

Le 1° 1 novembre 1976 . le requérant forma un recours de droit public

fondé sur l'article 6, paragraphe 2, de la Convention . A sa demande, l'affaire

t'ut ajournée vendant plusieurs mois, en considération de l'examen par la

Commission européenne des Droits de l'Homme de diverses affaires soulevant

des questions analogues (requêtes Neubeckeret Liebig c/République Fédérale

d'Allemagne ; Geerk c/Suisse) ; la procédure fut reprise après que ces diverses

affaires eussent fait l'objet d'un règlement amiable au sens de l'article 28 de la

Convention .

Le recours fut rejeté le 16 mai 1979 par la Chambre de Droit Public du

Tribunal fédéral suisse .

Dans son arrêt, le Tribunal fédéral rappelle en p re mier lieu qu'il s'agissait

d'une action pénale délenchée par citation di recte, dans laquelle n'intervient

aucune accusation publique . En ce cas les dépens ne peuvent pas être mis à la

charge du canton . Si le code de procédure pénale du canton (article 293) met

en principe les frais d'une telle procédure à charge de la pa rt ie succombante,

le tribunal peut s'écart er de cett e règle lorsque des - circonstances particulières • le justifient . Elle se réfère ensuite à la jurisprudence du Tribunal de

cassation du canton considérant comme • circonstances particulières • le contpo rt ement des part ies avant le procès et l'issue probable si aucune prescription

n'était inte rv enue .

Elle rappelle que sur la base de cette jurisprudence, les juges de la Cour

d'assises ont en l'espèce partagé les frais parce que d'une part l'article litigieux

avait été publié sans que le requérqnt ait pris les précautions nécessaires et

que celui-ci aurait été vraisemblablement condamné et, d'autre part, parce

que les manoeuvres commerciales des plaignants avaient en partie provoqué la

réaction du requérant .

Le Tribunal fédéral estime justifié de prendre notamment en considération, lors de la liquidation des frais, quelle partie l'aurait probablement

(vermutlich) emporté si la prescription n'était pas intervenue . Il ne voit aucune

raison de considérer que cette façon de procéder serait contraire à l'article 6 ,

paragraphe 2, ajoutant qu'aucune sanction de caractère pénal n'est imposée

en l'espèce et que rien dans les décisions rendues n'implique une reconnaissance judiciaire d'une culpabilité pénale de l'accusé ni équivaut à une condamnation . Sans doute, les juges de la Cour d'assises sont-ils arrivés à la conclusion, en anticipant pour partie sur l'appréciation des preuves, que le requérant

aurait vraisemblablement dû être condamné pour atteinte à l'honneur . Il

s'agissait toutefois uniquement d'une évaluation des chances de gagner le

procès (Wûrdigung der Prozesschancen) et non de la constatation judiciaire

d'une culpabilité pénale . La possibilité demeure ouverte que la poursuite du

orocès pénal eût conduit à l'acquittement du requérant .

GRIEFS

Le requérant allègue une violation de l'article 6, par . 2, de la Conventio n

Le requérant se plaint d'avoir été condamné à supporter une large part

pour atteinte à l'honneur, el à payer une indemnité 'de procédure aux plaignants, bien'que la plainte n'ait finalement pas été admiseen raison de la

prescription inteivenue entre-temps . Il met particuliérement en cause l'appréciation des juges . selon laquelle il aurait vraisemblablement d û être condamné

si la procédure n'avait pas été interrompue par la prescription .

Il allègue à cet égard la violation de l'article 6, paragraphe 2, de la

Convention, selon lequel toute personne accusée d'une infraction est présumée

innocente jusqu'à ce que sa culpabilité ait été légalement établie .

La Commissiôn observe toutefois que le requérant a fail l'objet de poursuites

pour une infraction visée au code pénal et passible d'une peine d'emprisonnement . Elle ne sauiait dès lors souscrire à l'argumentation du Gouvernement selon

laquelle la procédure ouverte en l'espèce échappait au domaine pénal couvert

par l'article 6, paragraphe 2 . et la requête serait, dâns son ensemble, incompatible rarione mareriae avec les dispositions de la Convention ati sens de

l'article 27, paragraphe 2 .

soit ., ont toutes fait l'objet d'un règlement amiable au sens de l'article 28 (b)

de la Convention .

Aucun autre motif d'irrecevabilité n'a par ailleurs été décelé .

Par ces motifs, la Commission, tout moyen de fond étant réservé ,

DECLARE LA REQUÊTE RECEVABLE .

THE FACT S

The fac4 of the case may be summarised as follow s

The applicant is a Swiss national born in 1932 . He is a journalist and

resides at Forch (Zurich) . He is represented before the Commission by

Mr Manfred Kuhn, a lawyer practising in Zurich .

In 1972 a private prosecution was brought against the applicant by a

commercial company and its director for libel committed in the press . In an

article published in January 1972 the applicant had accused them of fraud and

called for a house search and the detention on remand of the company's

director . He accused them of having caused involunta ry ent ries in a private

telephone directory by sending the persons concerned telephone bills similar to

those of the Post Office . The proceedings on this charge (Privatstrafklageverfahren), in which the Public Prosecutor played no part, were suspended for

several years at the ptaintifPs request while the results of another t rial re lating

to similar facts were awaited .

On 12 May 1976 the Chamber of [he Zurich Canton Assize Court

decided that the private prosecution was inadmissible owing to the supervenin g

expiration of the limitation period as the facts had occured more than 4 years

earlier . The decision (Beschluss) required the applicant to pay two-thirds of

the costs of the investigation and trial i .e . about 370 Swiss Francs and ordered

him to pay each of the plaintiffs compensation (Prozessentschïdigung) of

600 Swiss Francs to cover their counsel's fees .,

of Criminal Procedure by which costs need not be ordered against the unsuccessful party when there are "special circumstances" . The Court considered

what the judgment would have been if the limitation bar had not supervened

("wie das Urteil gelauter hiitte, wenn keine Verjïhrung vorliigé') and concluded

that if the applicant had taken the necessary precaution of making enquiries

with the persons whose conduct he had attacked, he wtiûld at most only have

been able to criticise the commercial methods employed ; he could not have

spoken of fraud owing to the absence of fraudulent intent . The Court referred

in this connection to the findings'of another Court in proceedings between the

same plaintiffs and another journalist, relating to similar facts . As the applicant

had nevertheless made an accusation of fraud he would almdst certainly have

been convicted of defamation in the present case if the limitation bar had not

supervened ("indem er das aber trotzdem .geian hat, w3re er aller Voraussicht

nach ini vorliegenden Ehrverletzungsprozess bei Nichtentritt der Verjïhrung'verurteilt worden") . According to the Court this conclusion'was confvmed in

particular by the fact that prosecution for fraud commenced at Mr Minelli's

remæst in another canton aeainst the company and its director (who were the

plaintiffs in the present case) had ended in a discharge (Einstellung) as it had

béen impossible to prove the constituent elements of the offence of fraud .

In fixing the costs the Court also took account of the plaintiffs' conduct

before the proceedings . It came to the conclusion that by their improper

commercial practices they had provoked the applicant's excessive reaction .

The applicant immediately applied to the Cantonal Court of Cassation to have

the decision set aside relying (inter n/ia) on Article 6 (2) of the Eûropean

Convention on Human Rights . This application was dismissed by â decision of

.

30 September 1976 .

On,•I November 1976, the applicant entered a public law appeal based

on Article 6 (2) of the Convention . On his application the case was adjourned

f'or several months in view of the fact that the European Commission of

Human Rights was investigating various cases raising similar questions

(Neubecker and Liebig v/Federal Republic of Germany ; Geerk v/Switzerland) ;

the proceedings were resumed afier these various cases had ended in friendly

settlement .s in accordance with Article 28 of the Convention .

The appeal was dismissed by the Public Law Chamber of the Swiss

Federal Court on 16 May 1979 .

In its judgment the Federal Court found that the case was principallv

concerned with a private prosecution and no charge was brought by the Public

Prosecutor . In such a case costs cannot be ordered aeainst the Canton .

Although the Cantonal Code of Criminal Procedure (Art . 293) lays down the

principle that the costs in such proceedings are to be paid by the unsuccessful

pa rt y, the Court can depart from this rule when to do so is justified by

"special circumstances" . It then referred to the case law of the Cantonal Court

of Cassation which treated the conduct of the parties before the trial, and the

probable result of the trial if the limitation bar had not supervened, as

"special circumstances"

. On the basis of this case law the Assize Court had divided the costs i n

the present case because firstly the article complained of was published

without the applicant's having taken the necessary precautions so that he

would probably have been convicted and secondly because the plaintiffs'

commercial practices had partly provoked the applicant's reaction .

The Federal Court held in particular that it was reasonable to take into

consideration when tixing the costs which party would probably (vermutlich)

have been unsuccessful if the limitation bar had not supervened . It saw no

reason to believe that this manner of proceedings was contrary to Article 6 (2)

and added that no criminal sanction had been imposed in the present case

and that nothing in the Court decisions in question implied a judicial recog .

nition of the accused's guilt or'was equivalent to a conviction . Certainly, the

judges of the Assize Court reached the conclusion, in anticipating the view

that would have been taken of the evidence, that the applicant would probably

have been convicted of defamation . This was, however, simplv an assessment

of' the chances of success of the proceedings (Würdigung der Prozesichancen)

and not a legal finding of guilt in criminal proceedings . The possibility

remained open that the continuation of the criminal proceedings would have

led to the applicant's acquittal .

COMPLAINTS

The applicant alleges a violation of Article 6 (2) of the Convention .

This provision implies that every person whose guilt has not been formall v

established by criminal trial must be treated, in all respects, as innocent and

there is no room for a person to be in an intermediary position between guilty

and innocent

. In the present case the finding by the Court tha~ the applicant woul d

have been guilty when there had been no hearing and no discussion of the

evidence clearly violated Article 6 (2) .

THE LA W

I . The applicant complains that he was ordered to pay a considerable

proportion of the costs of a private criminal prosecution brought against him

for defamation and to pay compensatiow to the plaintiffs for their legal

expenses . although the prosecution was finally dèclared inadmissible on account of the expiration of (he limitation"period . He complains particularly of

the Court's finding that he would probably have been convicted if the proceedings had not been interrupted by the limitation bar .

In this connection he alleges a violation of Article 6 (2) of the Convention

according to which everyone charged with a criminal offence shall be presumed

innocent until proved guilty according to law .

determined a criminal charge, proceedings for defamation instituted by a

private prosecution were in fact civil proceedings . Moreover, the Commission

had already established the civil nature of such proceedings in earlier cases4 . Private prosecution procedure has admittedly some special features .

However, the Commission notes that the applicant was prosecuted for an

otTence provided for in the Criminal Code and punishable by imprisonment . It

cannot accordingly accept the Government's argument that the proceedings in

the present case lie outside the criminal field covered by Article 6 (2) and that

the application was therefore, as a whole, incompatible ratione materiae with

the provision of the Convention wihtin the meaning of Article 27 (2) .

These applications, which raise inter a/ia, the question whether Article 6(2)

protects a person, who has not been convicfed by a final judgment, against an y

such complexity in fact and law that their determination should depend on an

examination of the merits . It follows that it cannot be dismissed as manifestly

ill-founded wihtin the meaning of Article 27 (2) of the Convention . Moreover,

no other grounds of inadmissibility have been established .

For these reasons, the Commissio n

DECLARES THE APPLICATION ADMISSIBLE without in any way

prejuding the merits .
