2 straipsnis Taikymo sritis 1. Šis reglamentas taikomas visoms pakuotėms, nepriklausomai nuo joms naudojamų medžiagų, ir visoms pakuočių atliekoms, nepriklausomai nuo to, ar tokios pakuotės yra naudojamos arba pakuočių atliekos susidaro pramonėje,, kituose gamybos, mažmeninės prekybos ar platinimo, paslaugų sektoriuose, biuruose ar namų ūkiuose. 2. Šis reglamentas taikomas nedarant poveikio Direktyvos 2008/98/EB nuostatoms, susijusioms su pavojingųjų atliekų tvarkymu, ir Sąjungos nustatytiems pakuočių reglamentavimo reikalavimams, pavyzdžiui, reikalavimams dėl saugos, kokybės, sveikatos apsaugos ir supakuotų produktų higienos, ir transportavimo reikalavimams. Tačiau, kai šis reglamentas prieštarauja Direktyvai 2008/68/EB, Direktyva 2008/68/EB yra viršesnė.
