21 straipsnis Atvejis, kai fizinių gamintojų pareigos taikomos importuotojams ir platintojams Jei importuotojas arba platintojas pateikia rinkai pakuotes savo vardu ar naudodamas savo prekių ženklą arba pakeičia jau pateiktas rinkai pakuotes taip, kad tai galėtų paveikti atitiktį atitinkamiems šio reglamento reikalavimams, tas importuotojas arba platintojas laikomas fiziniu gamintoju šio reglamento tikslais ir turi vykdyti fizinio gamintojo pareigas pagal 15 straipsnį. Jeigu pirmoje pastraipoje nurodytas importuotojas arba platintojas atitinka labai mažos įmonės apibrėžtį, nustatytą Rekomendacijoje 2003/361/EB, taikomoje 2025 m. vasario 11 d., ir pakuotes importuotojui arba platintojui tiekiantis fizinis ar juridinis asmuo yra Sąjungoje, pakuotes tiekiantis fizinis ar juridinis asmuo laikomas fiziniu gamintoju 15 straipsnio tikslais.

Common good practice already achieves an empty space ratio for single use transport packaging of 25 %. It is therefore appropriate to set this level at 20%.
