(Special legislative procedure – renewed consultation) The European Parliament,

• having regard to the Council draft (15401/2018),
• having regard to the Commission proposal to the Council ( COM(2016)0411 ),
• having regard to its position of 18 January 2018   Texts adopted, P8_TA(2018)0017 . ,
• having regard to Article 81(3) of the Treaty on the Functioning of the European Union, pursuant to which the Council consulted Parliament again (C8-0023/2019),
• having regard to Rules 50(1), 78c and 78e of its Rules of Procedure,
• having regard to the report of the Committee on Legal Affairs ( A8-0056/2019 ),

1Approves the Council draft as amended;

2Calls on the Commission to alter its proposal accordingly, pursuant to Article 293(2) of the Treaty on the Functioning of the European Union;

3Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;

4Calls on the Council to consult Parliament again if it intends to amend its draft substantially;

5Instructs its President to forward its position to the Council, the Commission and the national parliaments.
